[Nepal] Transitional Justice

In Nepal, the transitional justice process is facing difficulties even 10 years after the end of the conflict. Indeed the two commissions established by the government to implement transitional justice, the Truth and Reconciliation Commission (TRC) and Commission on theInvestigation of Enforced Disappeared Persons (CIEDP) have received heavy criticism. 

 

The UN has denounced the Nepali government for not amending the Investigation of Disappeared Persons, Truth and Reconciliation Commission Act, 2014, which currently does not prevent perpetrators from receiving amnesties. The commissions have also been a short time frame of only two years to complete their tasks. Moreover, victims have accused the commissions of serving as tools for protecting the government officials from being prosecuted instead offacilitating the process of transitional justice. As a result, they are often hesitant to file complaints or when they do, they leave out important details or refuse to identify the perpetrators.
